Which South Walton rule applies to your shoreline?
Start by naming your water. Walton County treats Choctawhatchee Bay, the coastal dune lakes and the Gulf beach as three separate rulebooks.
| Shoreline | New vertical bulkhead? | What the rules point you to |
|---|---|---|
Choctawhatchee Bay and connected bayous | Not allowed, except an infill lot between two existing seawalls, 150 feet or less | Revetments, riprap, native plants and other wave-absorbing options |
Coastal dune lakes (within 300 feet) | Not allowed; riprap and revetments are banned too | Docks, boardwalks and native buffers |
Gulf beach | Only after FDEP grants a coastal armoring permit | State review first; the county waits for it |
Inside Freeport city limits | City code lists riprap, not seawalls, as a permittable shoreline use | City Planning & Zoning first |

Ask about replacement in writing. The bay rule speaks of “new” walls. It does not say how the county treats a full replacement of an existing wall, so get Planning’s answer before demolition.
South Walton area guides: who permits your shore
Each local guide names the permit office, the water and the rule that matters most for that shore.
- Miramar Beach & Sandestin bayside: Walton County. Miramar Beach is not a city, so Destin City Hall does not permit here.
- Santa Rosa Beach, Hogtown Bayou & Point Washington: Walton County
- Freeport & LaGrange Bayou: Inside city limits: Freeport Planning & Zoning, then Walton County. Outside: Walton County.
- Choctaw Beach & Basin Bayou: Walton County
- 30A coastal dune lakes: Walton County, plus state and federal review for docks
Can you build a new seawall on Choctawhatchee Bay?
Usually not. Walton’s code bans new vertical seawalls and bulkheads along the bay. The exception is a lot directly between two lots with existing seawalls, where the new wall is 150 feet or less. LDC 4.03.03.B.4
State law leans the same way. Florida’s infill exemption uses the same 150-foot test, but its estuary limits still apply. s. 403.813(1)(o), F.S. For a failing vertical wall in an estuary, FDEP generally wants riprap facing or a switch to riprap. s. 373.414(5), F.S.
- Riprap (loose rock laid on a slope) at the toe of an existing wall can fit a state general permit: up to 10 feet out, at a 2:1 slope or flatter. Rule 62-330.431
- Living shoreline plantings along 500 feet or less, reaching no more than 10 feet out, can be exempt from the state permit. A low breakwater may be added. Rule 62-330.051(12)(e)
- Local help: the Choctawhatchee Basin Alliance has helped build nearly 70 living shorelines and offers technical and permitting support. USFWS story on CBA
The county’s comprehensive plan encourages living shorelines and lets the code decide erosion control in the bay buffer. Comp Plan C-1.4.2 and C-1.4.3 Compare options in the living shoreline guide and the riprap and toe protection guide.
The 50-foot bay buffer and dock limits
The Bay Shoreline Protection Zone covers the bay and all land within 50 feet of mean high water (MHW). MHW is the average high-tide line. The zone includes bayous connected to the bay. LDC 4.03.03.B
- No development in the 50-foot band except boardwalks, public access and the land end of permitted docks.
- Clearing of native plants is capped at 25% of the zone on a site.
- Septic drain fields must sit at least 75 feet from the water line.
- Some older, shallow lots may use a smaller buffer, so ask Planning about yours.
Docks may not cross seagrass except to reach water one foot deeper than the boat’s lowest point at mean low tide. LDC 4.03.03.B.3 Bay seagrass grows on the shallow edges of the middle and western bay. FWC seagrass report
The main bay, Hogtown Bayou and Jolly Bay are also Gulf sturgeon critical habitat. That can add a federal consultation to a Corps permit. 50 CFR 226.214
Coastal dune lakes: no bulkheads within 300 feet
The answer here is simple. Seawalls, bulkheads, revetments and riprap are not permitted within 300 feet of a coastal dune lake or its tributaries. LDC 4.02.03 The ban is also written into the comprehensive plan. Comp Plan CM-1.1.1
It is hard to change, too. Since March 24, 2026, amending these lake rules takes at least four of five county commissioners. Ordinance 2026-04
- 100-foot setback: no building or clearing within 100 feet of the lake, except docks, boardwalks and one 10-foot access path. LDC 4.02.03.G-H
- Outlets: keep a 50-foot undisturbed buffer on each side of a lake’s natural outlet.
- Clearing permit: any clearing inside the 300-foot zone needs a county Land Clearing Permit.
- Dock lights: off after 10 p.m. or when not in use, with full-cutoff, low pressure sodium or LED fixtures. LDC 5.09.03
- Lake Powell: it is an Outstanding Florida Water, so the state dock exemption tops out at 500 square feet instead of 1,000. Rule 62-302.700 s. 403.813(1)(b), F.S.

Gulf-front armoring needs FDEP first
A Gulf-front seawall in South Walton is coastal armoring, and FDEP decides it under the Coastal Construction Control Line (CCCL) program. Walton’s current line took effect Aug. 25, 2009. Rule 62B-26.001
The county will not approve construction seaward of the line, including shore protection, until state and federal permits are in hand. Fill south of Scenic Gulf Drive, US 98 and CR 30A cannot use red or yellow clay. LDC 4.02.05.B and 4.07.02
- Who qualifies: FDEP may permit armoring for an “eligible” structure that is “vulnerable” to a 25-year storm, or to close a gap of up to 250 feet between armored lots. Permit history matters, since the eligible list includes homes not built under a DEP permit on or after March 17, 1985. Rules 62B-33.0051 and 62B-33.002
- Repairs need a permit: the state repair exemption excludes seawalls. s. 161.053(11)(a), F.S.
- July 7, 2026 rule change: replacing or upgrading existing armoring no longer means re-proving eligibility, if impacts are not significant. New designs need a 30-year design life and must account for 30 years of sea level rise. Rule 62B-33.0051, 2026
- Fees: FDEP charges $3,000 for armoring up to 100 feet, plus $500 per extra 50 feet. Rule 62B-33.0085 Walton adds a $45 Coastal Armoring Permit and a $40 CCCL consistency review. Resolution 2023-26
- After a storm: temporary armoring a local government allows must come out within 60 days unless the owner applies for a permanent permit. s. 161.085, F.S.
- Walls from 2005-06: a 2011 law let Walton armoring built between July 10, 2005 and April 30, 2006 stay. Sellers must give buyers notice of its terms. Ch. 2011-261, Laws of Fla.
FDEP lists 18.8 miles of Walton’s Gulf beach as critically eroded, including 5.2 miles around Miramar Beach and Sandestin. DEP critically eroded beaches, June 2026 Walton beaches had 42 loggerhead and 26 green turtle nests in 2025. FWC 2025 nesting totals Questions about the line go to the CCCL program at (850) 245-8570. - Building plans in the Coastal Building Zone, which the county describes as bay to beach, must be certified by a Florida architect or engineer. Building Division and Ord. 2007-53
- Owner-builder exemptions for small sheds and additions do not apply in that zone.
- Ask Planning which review your shoreline scope needs before you file with Building.
Inside Freeport: city zoning, county building permit
Freeport has its own city government, and it splits the job. The city’s Planning & Zoning office reviews the packet first, in about 7 to 10 business days once it is complete. The contractor then takes the city approval to the Walton County Building Department. Freeport building process sheet
- Check city limits: a “City of Freeport” line on the tax bill, or the tax district on the Property Appraiser site, shows the parcel is in the city. City of Freeport
- Shoreline zone: the city protects a strip reaching 50 feet landward of the water’s edge. Docks 4 feet wide or less are presumed to have little effect there. Freeport LDC 4.01.03
- Riprap, not seawalls: new riprap along up to 50 feet of shoreline is a permittable special use, and seawalls and bulkheads are left out of that list. Freeport LDC 4.01.04.C
Outside city limits, county Planning handles the review. The Freeport and LaGrange Bayou guide has the local detail.
What do Walton bulkhead permits cost in late 2026?
Walton prices docks, seawalls and boathouses on the contract cost. The rates below come from Resolution 2025-70. Resolution 2025-70
| Contract cost | Building permit fee |
|---|---|
Up to $7,000 | $35 minimum |
$15,000 to $50,000 | $75 for the first $15,000, plus $4 per additional $1,000 |
$50,000 to $100,000 | $215 for the first $50,000, plus $3 per additional $1,000 |
$100,000 to $500,000 | $365 for the first $100,000, plus $2 per additional $1,000 |
- Plan review is 10% of the permit fee, with a $25 minimum collected at submittal.
- Reinspections cost $30 per trip per trade.
- Two 2025 resolutions cut building permit fees to $0 at issuance through Sept. 30, 2026. We found no extension, so expect the table to apply now. Resolutions 2025-58 and 2025-70
- Planning fees are separate, such as $450 for a variance plus a $75 environmental review. Resolution 2023-26
- FDEP charges $100 to verify an exemption and $250 for a general permit. Rule 62-4.050
Permit fees are a small slice of the work. Plan the full job with the bulkhead cost guide.
How do you check a Walton marine contractor?
State-certified contractors must register their state license with Walton County before they work there. County licenses expire Aug. 31 each year. Renewal needs liability and workers’ comp certificates naming the Walton County Building Department. County registration rules
- Walton issues a local Division III “Marine” license. Fees are $50 for residents, $125 for nonresidents and $200 for out-of-state applicants. Division III sheet, 06/11/26
- Florida also certifies a marine specialty contractor, created in 2024, for seawalls, bulkheads, docks and pile driving. Rule 61G4-15.100
- Contractors who skip renewal two years in a row are purged and must reapply. Walton licensing
- The Contractor Competency Board investigates complaints and holds disciplinary hearings. Walton Competency Board
Ask for the Walton registration, not just a state number. Licensing questions go to the Building Division at (850) 892-8160. Then follow the contractor check steps.
