Valparaiso rewrote its waterways code in October 2024, and it names three bayous: Boggy, Weekley and Toms. One rule matters most after a storm. A damaged dock or wall can come back at its old size or smaller only if the city permit is applied for within six months. The same code bars boat wakes that damage seawalls. All of Weekley Bayou inside the city is a no-wake area.

What to check on a Valparaiso bulkhead or dock
Start with the calendar. The National Weather Service's preliminary report puts Hurricane Isaias's landfall near Destin on October 9, 2026 NWS preliminary Isaias report. If that storm damaged your bulkhead (seawall) or dock, six months from that date runs to early April 2027. City code counts from the date of damage, so confirm the start date with the city Valparaiso Code Sec. 83-28.
Checks on the wall and dock
- Wake damage. City code bars running a boat fast enough to make waves that damage docks or seawalls Valparaiso Code Ch. 83. Photograph fresh scour along the toe, where the wall meets the mud, and note the date and any boat you saw.
- The 35 percent line. If more than 35 percent of a dock's materials are broken, torn loose or deteriorated, it must be repaired. The building inspector measures it by square footage Valparaiso Code Sec. 83-8. Count bad boards, stringers and piles before the city does.
- City land at the water. Since June 2025, no new docks may abut city-owned property, and existing ones there need commission approval, liability insurance naming the city and a hold-harmless release to be repaired Valparaiso Code Sec. 83-22.
- Land just behind the wall. Along the bay and the three bayous, a 5-foot strip just above mean high water (MHW, roughly where ordinary high tides reach) bars most new structures and clearing Valparaiso Code Sec. 102-31. Ask how a replacement wall is treated there.
- Cap and panels. Check the cap, the concrete beam on top, for cracks and rust. Our cap and panel repair guide explains what each sign means.

Revetments, the city's word for seawalls and shoreline armor, need a city permit like docks do Valparaiso Code Sec. 83-22. Weigh repair against replacement before the six-month window closes.
What could the work cost?
Call City Hall for the current permit fee before you set a budget; we could not confirm the fee schedule online. Price the dock apart from the wall, since a dock past the 35 percent line must be repaired either way. Missing the six-month window can change what you are allowed to rebuild, so do not let a quote sit.

Valparaiso & Toms Bayou project questions
How long do I have to rebuild a storm-damaged dock in Valparaiso?
Six months from the date of damage to apply for the city construction permit, if you want to rebuild at the same or smaller size. The rule covers damage from accidents, vandalism and acts of God. State and federal approval duties do not change, so start those files right away.
Valparaiso Code Sec. 83-28 Reconstruction of existing facilities
Can I build a dock if a city street separates my house from the water?
It depends, so ask before paying for design. Sec. 83-23 lets an owner-occupied single-family home have a dock when a public right-of-way interrupts its lot lines. But since June 2025, Sec. 83-22 bars new docks abutting city-owned property. Ask the city which rule governs your frontage.
Valparaiso Code Sec. 83-23 Construction and/or renovation restrictions · Valparaiso Code Sec. 83-22 Structures requiring permits
Can Valparaiso make me repair an old dock?
It can. The trigger is more than 35 percent of a pier's or dock's materials broken, torn loose or structurally deteriorated. Then it must be repaired so it is sound and uniform. The building inspector measures by square footage, and the city notifies the owner by registered letter.
What can I do about boat wakes hitting my seawall?
Cite the code. Valparaiso bars running a boat at a speed that makes waves damaging docks, wharves, seawalls or moored boats. All of Weekley Bayou inside the city is a no-wake area. Keep dated photos of the damage when you report it.
