Marina Bulkhead Repair in Destin: Permits, Leases & Phasing
Marina bulkhead work in Destin has to keep boats moving, satisfy several agencies and protect a lease. Start with your operating needs, then build the design and permits around them.
Start with slips, fuel and the busy season
A marina bulkhead holds up more than soil. It often carries fuel lines, power, water, cleats and foot traffic. Write down what must stay open during the work.
- Slips, fuel docks and haul-out areas, by wall section.
- Utilities that run along or through the cap.
- Charter departure times and the busiest months.
- Where barges, cranes and materials can stage.
- Spill response: DEP lists the State Watch Office at 800-320-0519 and the National Response Center at 800-424-8802. DEP spill contacts
Destin Harbor is busy water. The city says tens of thousands of boats use it each year, through a 100-foot-wide Army Corps channel from East Pass. City of Destin funding request Plan barge access and work hours around that traffic.
Design questions for a working waterfront
A harbor bulkhead takes prop wash and boat wake every day, then surge in a storm. Ask the engineer to design for both.
In Hurricane Isaias, preliminary NWS data show water about 4 feet above mean higher high water at the Old Pass Lagoon gauge in Destin Harbor. Mean higher high water (MHHW) is the average of each day’s higher high tide. NWS Isaias report
- How deep is the wall? The Destin Army Recreation Area seawall damaged by Hurricane Michael lies mostly below water, to a depth of 17 feet. U.S. Army report
- Can docks ride the surge? When DEP named Legendary Marine in Destin a Clean and Resilient Marina in 2018, it cited floating docks that rise with surge and pilings rated for a Category 2 surge. DEP release
- Can the wall stay vertical? On estuary seawall repairs, Florida generally expects riprap facing unless a listed condition applies, such as a wall needed for a marina. Section 373.414(5), Fla. Stat.
Start the engineering with a full bulkhead assessment, and check whether tiebacks and anchors need work too.
Permits, leases and the money on your lease
Where a marina sits over state-owned submerged land, the bay bottom the state holds in trust, revenue-generating use needs a lease. Shoreline protection built as part of a leased docking facility is handled under that lease. Rule 18-21.005, F.A.C.
| Factor | Effect on the annual lease fee |
|---|---|
Standard-term lease | 6% of annual income, the base fee or the minimum fee, whichever is greater |
90% or more of slips open to the public, first come, first served | 30% discount |
DEP Clean Marina designation kept current | 10% discount |
These terms come from the state lease rule and statute. Rule 18-21.011, F.A.C. Section 253.0346, Fla. Stat. Clean Marina status is voluntary: a facility must meet all DEP rules and adopt at least 60% of the program’s best practices. DEP Clean Marina Program
Ask whether the project changes the lease footprint. Also ask the contractor for proof of Longshore and Harbor Workers’ Compensation coverage, which Florida’s rule names for certified marine specialty contractors. Rule 61G4-15.100(4), F.A.C.
Common questions
Can we keep slips open during the work?
Often in part. Ask the contractor for a section-by-section plan that shows which slips, fuel points and walkways close, and when.
Does Clean Marina status affect our lease?
It can. Keeping a DEP Clean Marina designation earns a 10% discount on a state submerged land lease fee.
Do we need a lease change for a new bulkhead?
Ask DEP early. Shoreline protection built as part of a leased docking facility is handled under the lease, so a footprint change may affect it.
Who reviews marina projects at the state level?
In this region DEP generally handles marinas and docks, not the water management district. Federal review goes to the Army Corps.
Is a vertical wall still allowed on the harbor?
State law limits vertical seawalls in estuaries, with exceptions that include walls needed for a marina. The agencies decide whether your site qualifies.
What should the contractor carry?
Check the state license and the county or city registration. For certified marine specialty contractors, Florida’s rule names Longshore coverage among the required insurance.
Destin Harbor adds a city layer
In Destin Harbor, the city will not issue a permit for a dock, seawall or bulkhead until federal and state approvals are in hand. The city file must include the joint Army Corps and DEP application. Destin LDC 11.05
| Charge | Amount |
|---|---|
Building permit, docks and seawalls | $16.30 per $1,000 of construction cost, plus a $33 planning fee and a $77 processing fee Resolution 25-10 |
Marine application, commercial | $1,000 per application Resolution 25-10 |
Net Positive Environmental Benefit, harbor and canals | 25% of construction cost for marinas, docks and piers, paid before the permit Destin LDC 11.05.02.N |
These fees come from Resolution 25-10, adopted May 5, 2025; confirm the current schedule. Whether the 25% charge applies to a bulkhead-only repair is not confirmed, so ask Planning early.

Seagrass and sturgeon near East Pass
Seagrass grows only in the middle and western parts of Choctawhatchee Bay. In 2013 imagery, the most heavily prop-scarred beds were near Destin, just inside the pass. FWC seagrass report FWC prop-scar finding
The bay is also Gulf sturgeon critical habitat, bounded on the south by a line across East Pass. 50 CFR 226.214 Ask the Army Corps early how that affects review of in-water work.
- Over seagrass, Corps and NMFS guidelines call for decks at least 5 feet above mean high water and walkways no wider than 4 feet. USACE/NMFS dock guidelines
- Federal permits for Okaloosa and Walton go through the Corps’ Pensacola Permits Section. USACE Pensacola Section
Marinas on the bayous and in Niceville
Niceville requires city council approval for a new marina or commercial dock, or an addition to one. Its code says those steps do not apply to repair or remodeling of an existing facility. Niceville Code Ch. 4.5
Rocky Bayou east of the State Road 20 bridge is an aquatic preserve. New seawalls may not go waterward of mean high water there. But restoring a wall at its old line, or up to one foot waterward, needs no state-lands application. Rule 18-20.004, F.A.C. Rocky Bayou preserve plan
Repairs there still need a building permit and the usual state and federal review. The permit guide lists the offices.
