Condo Bulkhead Repair in Destin: SIRS, Reserves & Votes

For a Destin condo association, the bulkhead is a safety and budget question. Start with the engineering reports you already have and what Florida’s reserve study law asks for.

Is the bulkhead in your structural integrity reserve study?

A structural integrity reserve study (SIRS) is a required study of key building parts and how to fund them. Florida requires one at least every 10 years for each condo building three habitable stories or higher. Section 718.112(2)(g), Fla. Stat.

Seawalls are not on the named list. But the study must also cover any other item over a dollar threshold whose failure would harm the listed items, such as the structure. DBPR set that threshold at $25,675 for 2026. SIRS catch-all item

  • Ask your engineer, in writing, whether the bulkhead meets that test for your building.
  • Check the developer’s turnover report. Florida’s turnover inspection list names “Seawalls.” Section 718.301(4)(q), Fla. Stat.
  • Keep the milestone inspection and the SIRS apart; they are separate requirements. DBPR SIRS guidance

Associations that existed by July 1, 2022 had a December 31, 2025 SIRS deadline. The statute adds: “In no event may the structural integrity reserve study be completed after December 31, 2026.” SIRS deadlines

Reserves, special assessments and bids

If the bulkhead is a SIRS item, its reserve cannot be waived for budgets adopted on or after December 31, 2024. Owners also cannot vote to spend those reserves on something else. Section 718.112(2)(f), Fla. Stat.

03 · Residents & access

Plan for residents, renters and access

Bulkhead work at a condo affects people who never see a board packet. Some owners live elsewhere, and some units may be rented. Plan the notices before equipment arrives.

  • Staging and parking: where equipment and materials will sit.
  • Pool decks, walkways and docks that will close, and for how long.
  • Boat slips that must be emptied, and where those boats can go.
  • Work hours, and how rental guests will be told.
  • One contact residents can call with questions during the work.

Post permits for planned work and the bid list as Florida requires for associations with 25 or more units. Section 718.111(12)(g), Fla. Stat. Use the scope checklist to keep bids comparable, and the insurance guide before a storm claim.

Include resident access needs

Keep the next review in view.

Ask about a maintenance plan to keep records up to date and arrange a sensible schedule for future checks.

Common questions

Does the SIRS have to include the seawall?

Not by name. It must include items over the threshold whose failure would harm the listed building parts. Ask your engineer to answer that for your wall in writing.

Can owners vote to skip bulkhead reserves?

If the bulkhead is a SIRS item, no, for budgets adopted on or after December 31, 2024. Other reserves can still be waived or reduced by a majority of total voting interests.

Do we need bids for engineering?

Florida exempts engineering and architect services from the condo bid rule. Construction contracts over 5% of the total annual budget need bids.

Will our master policy pay for the wall?

Do not assume so. The federal condo flood policy excludes seawalls. Ask your agent about each private policy in writing.

What must we post for owners?

Associations with 25 or more units must post inspection reports, the latest SIRS, permits for planned work and the list of bids on their website.

Can the SIRS engineer also bid on the repair?

Florida requires anyone who bids on the study to disclose in writing any plan to bid on the resulting repairs. Without that disclosure, the contract is voidable.

DBPR data does not show which ones front the water. In a separate DBPR extract, 87 Walton projects carry a “Destin” address, mostly on the Miramar Beach and Sandestin side outside Destin city limits. DBPR condo extract

That matters for permits. Miramar Beach is an unincorporated community, so a condo there files with Walton County, not the City of Destin. Census place status Walton Building Division See the Walton County guide or the Okaloosa County guide.

Harbor-front and Gulf-front condos face extra layers

Location adds cost and review on top of the condo rules.

  • Destin Harbor docks: the city charges a Net Positive Environmental Benefit of 25% of construction cost for marinas, docks and piers in the harbor and its canals, paid before the permit. Destin LDC 11.05.02.N
  • V zones: in Destin’s coastal high hazard areas, a seawall needs a design professional’s analysis showing it will not divert waves onto neighboring buildings. Destin LDC 11.04.17.G
  • Gulf armoring: DEP’s application fee is $3,000 for up to 100 feet plus $500 per extra 50 feet; minor reconstruction is $500. Rule 62B-33.0085, F.A.C.

Whether the harbor charge applies to a bulkhead-only repair is not confirmed. Ask Destin Planning before the budget goes to owners, and use the permit guide to list every review.
