Niceville writes its bayous into its code by name: Boggy, Rocky and Shirks. The city runs its own building department on Partin Drive, and its online permit portal is still listed as coming soon. Niceville does not treat a seawall as an accessory structure, so a lot owner can permit a new or replacement wall before a house. The Land Development Code is being rewritten, with adoption hearings set for early 2027.

What to check on a Boggy Bayou bulkhead
Start with the 5 feet of land behind your bulkhead (seawall). Niceville protects the first 5 feet of land above the mean high-water line (MHW, where an average high tide stops). The rule covers the bay and its three bayous. New structures and clearing are barred there unless excepted Niceville LDC 11.01.01. Get a written answer from Planning on how a replacement wall fits that rule before demolition.
Checks for Boggy Bayou lots
- Runoff and sediment. The city won a $4,223,000 NFWF grant in 2014 for Boggy Bayou water quality, including sediment control at the bayou outfall NFWF project page. Look for silt fans, washouts and sinkholes behind the cap, the concrete top beam. See soil loss behind a bulkhead.
- Water depth for a dock. The city's own Old Town Landing dock and pier on Boggy Bayou drew only two bids, and board minutes say no dredging is permitted there Niceville CRA records. If your plan needs deeper water, ask about dredging before design.
- Lift and roof height. The top of a boat shelter, lift or dock may not exceed 10 feet above mean sea level Niceville LDC 7.08.05.
- Flood zone. Niceville holds a Community Rating System Class 6, worth a 20 percent discount on NFIP policies in Special Flood Hazard Areas City of Niceville floodplain page. Ask for a flood map determination before design.
- Neighbors. A dock or moored boat closer than 25 feet to a side lot line needs written notice to the neighbors first Niceville LDC 7.08.05.
Do not count on Florida's new under-$7,500 permit exemption for a minor wall or dock fix. Niceville says it does not cover structural work or property in a Special Flood Hazard Area Niceville HB 803 page. Compare repair and replacement, then map out the permit steps.
What could the work cost?
Expect few bidders for marine work on the bayous; the city's Old Town Landing dock drew two. Niceville sets its permit fee by the value of the work, and residential plan review adds 25 percent of that fee. Price the seawall, the dock and any lift as separate lines, since each follows its own rules.
These per-foot figures are 2019 City of Destin bids for a 325-foot public park seawall. They are not a residential quote or a 2026 market average; your written, itemized scope sets the real price.

Niceville steps in the right order
Niceville's code puts state and federal approval ahead of the city permit. Follow these steps so nothing sits waiting on the wrong office.
Start with FDEP and the Corps
No one may build or add to a dock, seawall or bulkhead without federal and state authorization. Gather those approvals first, then apply to the city.

Check the dock against three caps
The smallest of these wins: 20 percent of the bayou's width, 200 feet, or the lot's width at mean high water. Lots under 50 feet of frontage cannot have their own dock.

Know the setback for new building
Homes and other residential development must sit at least 25 feet behind the shoreline zone, about 30 feet from mean high water. Keep this in mind if wall work comes with a new deck or addition.

Watch the code rewrite
Niceville is rewriting its Land Development Code, with a Planning Commission hearing in November 2026 and Council adoption hearings in January and February 2027. Recheck dock numbers before final design.

Niceville & Boggy Bayou project questions
Can I get a seawall permit on an empty Niceville lot?
Yes. Niceville's code says seawalls are not accessory structures, so a seawall permit may be issued before a permit for the house. A dock or lift still follows the accessory rules. You will still need state and federal authorization before the city issues its permit.
Does the new $7,500 permit exemption cover bulkhead repair in Niceville?
Unlikely. Niceville's guide to the 2026 HB 803 exemption says it does not cover structural work or property in a Special Flood Hazard Area. Seawall and dock repairs usually involve structural parts. Even exempt work needs a written exemption request to Community Development.

How long can a dock be on Boggy Bayou?
No longer than 20 percent of the bayou's width at that spot or 200 feet, whichever is less. It also cannot be longer than your lot is wide at mean high water. Walkways must be 3 to 6 feet wide, with side setbacks of at least 10 feet. Floating docks are capped at 20 feet along the frontage.

How do I apply in Niceville without an online portal?
Bring the application to 212 Partin Drive N or email it to building@nicevillefl.gov. The city lists its online portal as coming soon. Email inspection requests to inspections@nicevillefl.gov by noon for next-business-day service. Real city emails come only from @nicevillefl.gov addresses.
